Under California law, The Fiscal Flow is a "business" as defined by the CCPA. This means we collect California residents' personal information and determine the purposes and means of processing that information.

4. RIGHT TO DELETE

Exceptions to Deletion

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Debug products to identify and repair errors
  • Exercise free speech, ensure another consumer's right to free speech, or exercise another right provided by law
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.)
  • Engage in public or peer-reviewed scientific, historical, or statistical research that conforms to certain ethical standards
  • Enable solely internal uses reasonably aligned with consumer expectations based on your relationship with us
  • Comply with a legal obligation
  • Otherwise use the information internally in a lawful manner compatible with the context in which you provided it

5. RIGHT TO CORRECT

Under the CPRA, you have the right to request that we correct inaccurate personal information that we maintain about you. Upon receiving and verifying your request, we will use commercially reasonable efforts to correct the inaccurate information.

If we believe the information is accurate, we will notify you and explain why we will not make the correction.


6. RIGHT TO OPT-OUT OF SALE/SHARING

Under the CCPA, you have the right to opt out of the "sale" or "sharing" of your personal information. California law defines "sale" broadly to include many types of data transfer for valuable consideration. "Sharing" includes cross-context behavioral advertising.

How to Opt Out

If we engage in activities that constitute "sale" or "sharing" under California law:

  • Cookie-based opt-out: You can manage your cookie preferences through our cookie consent banner (when you first visit) or by adjusting your browser settings.
  • Global Privacy Control (GPC): Some browsers support the Global Privacy Control signal. If you enable GPC, we will treat that as a request to opt out of the sale/sharing of your information.
  • Direct request: You can email us at thefiscalflow [at] gmail [dot] com with "CCPA Opt-Out" in the subject line.

Opt-Out Preference Signal: If you use a browser or browser plugin that sends a Global Privacy Control (GPC) signal, we will honor that signal as a valid opt-out request.


7. RIGHT TO LIMIT USE OF SENSITIVE INFORMATION

Under the CPRA, you have the right to limit the use of "sensitive personal information" to only what is necessary to provide the services you request. Sensitive personal information includes:

  • Social Security number, driver's license, state ID, passport number
  • Account log-in credentials
  • Precise geolocation
  • Racial or ethnic origin, religious beliefs, union membership
  • Genetic data
  • Health information
  • Sex life or sexual orientation

We do NOT collect any sensitive personal information as defined by California law. Therefore, this right does not apply to our data practices. If this changes in the future, we will update this page.


8. RIGHT TO NON-DISCRIMINATION

You have the right not to receive discriminatory treatment for exercising your CCPA rights. We will not:

  • Deny you goods or services
  • Charge you different prices or rates
  • Provide you a different level or quality of services
  • Suggest that you may receive a different price or rate for services

We may, however, offer different prices or rates if the difference is reasonably related to the value provided by your data.


9. HOW TO EXERCISE YOUR RIGHTS

To exercise any of your California privacy rights, please submit a request through one of these methods:

Method 1: Email

  • A clear description of the right you wish to exercise (Know, Delete, Correct, Opt-Out)
  • Your full name and email address associated with your interactions
  • Any additional information that will help us process your request

Method 2: Contact Form

Visit our Contact Us page and submit a message with "CCPA Request" in the message.

Method 3: Toll-Free Number (if applicable)

We currently do not operate a toll-free number due to our size, but you can reach us via email.

Response Time: We will acknowledge receipt of your request within 10 business days and provide a substantive response within 45 calendar days. If we need more time (up to 90 days total), we will explain why.

Requests are free of charge. However, if your request is manifestly unfounded or excessive, we may charge a reasonable fee or refuse to act on the request.


10. VERIFICATION PROCESS

To protect your privacy and security, we must verify your identity before processing your request. The verification process depends on the type of request:

Right to Know (categories only) We will match your email address with our records. For low-risk requests, this may be sufficient.
Right to Know (specific pieces) We require a greater level of verification due to the sensitivity of specific information. We may request additional information or a signed declaration under penalty of perjury.
Right to Delete We will verify your email address and may request additional information to confirm identity.
Right to Correct We will verify your identity and review the information you claim is inaccurate.
Right to Opt-Out Opt-out requests do not require verification. However, if you submit an opt-out request through email, we may verify to ensure it's not a fraudulent request.

If we cannot verify your identity, we may deny your request. We will notify you if this occurs and explain the reason.


11. AUTHORIZED AGENTS

You may designate an authorized agent to make a CCPA request on your behalf. To do so:

Requirements for Authorized Agents:

  • The agent must be registered with the California Secretary of State to conduct business in California.
  • You must provide the agent with signed permission to act on your behalf.
  • We may require you to verify your identity directly with us.
  • We may require the agent to provide proof of registration and authorization.

If you are an authorized agent submitting a request on behalf of a California resident, please email us with:

  • "CCPA Authorized Agent" in the subject line
  • Proof of your registration with the California Secretary of State
  • A copy of the signed authorization from the consumer

12. DATA RETENTION

We retain your personal information only as long as necessary for the purposes described in this policy or as required by law.

After the retention period ends, we will securely delete or anonymize your data.


13. MINORS UNDER 16

Our Site is not directed at minors. We do not knowingly collect personal information from minors under 16 years of age.

Under 13

If we learn we have collected personal information from a child under 13, we will delete it immediately. If you believe a child under 13 has provided us with personal information, please contact us.

13 to 16

For minors between 13 and 16, we do not sell or share their personal information without affirmative authorization. We do not knowingly collect information from this age group.


14. DO NOT TRACK SIGNALS

Some browsers have a "Do Not Track" (DNT) feature that signals to websites that you do not want your online activity tracked. California law requires us to disclose how we respond to DNT signals.

Our Response: Our Site does not currently respond to DNT signals because there is no consistent industry standard for interpreting them. However, California residents can exercise their opt-out rights through the methods described in Section 9.

We do honor Global Privacy Control (GPC) signals as opt-out requests as described in Section 6.


15. FINANCIAL INCENTIVES

The CCPA requires disclosure of any financial incentives offered in exchange for the retention or sale of personal information.

We do not offer any financial incentives or price differences in exchange for your personal information. We do not participate in "pay-for-privacy" programs or offer discounts in exchange for data.

If this changes in the future, we will provide clear notice and obtain your consent before enrolling you in any financial incentive program.


16. CALIFORNIA "SHINE THE LIGHT" LAW

California's "Shine the Light" law (Civil Code Section 1798.83) gives California residents the right to request, once per year, information about our disclosure of personal information to third parties for their direct marketing purposes during the previous calendar year.

We do not disclose personal information to third parties for their direct marketing purposes. If this changes, we will update this policy.

To make a request under "Shine the Light," please contact us with "Shine the Light Request" in the subject line.
